Firstly, it is crucial to note that as well cannabis is considered a drugs crime under the criminal law in Mauritius, and the country maintains a 'zero' tolerance policy towards such offenses.

Bail Procedures for Accused Prisoners in Mauritius

Information about procedures to request for bail

In Mauritius, the average pre-trial period for foreigners involved in drug related crimes ranges from 2 to 7 years. During this period, the police will thoroughly investigate the case, and the results from the forensic lab may take up to 2 years to be obtained, adding to the duration of the pre-trial period.

If you wish to request bail for the accused, certain elements need to be considered:
 

  1. Family ties in Mauritius: The presence of family connections within Mauritius may positively influence the bail decision.

  2. Registered assets: If the accused owns property, such as a house, in their name, it may impact the bail decision.

  3. Income source: The availability of a stable income for the accused could be a factor in determining the bail.

  4. Accommodation arrangement: The accused should have suitable accommodation for the duration of the court case.

  5. Sufficient funds: Ensuring there are enough funds available to meet the bail amount is crucial.

  6. Local surety: A local surety must be willing to stand as a guarantor and accept financial and personal risks in case of absconding.

  7. Valid visa: The accused should possess a valid visa for at least 12 months.
     

Typically, for cannabis cases involving foreign nationals, the average bail amount is approximately 1 million MUR. The court will provide detailed explanations regarding the conditions associated with the bail. These conditions typically include signing in at the local police station once or twice daily, observing a curfew between 6 pm and 6 am, and avoiding specific areas, such as the beach, to mitigate absconding risks.
 

Once a bail motion is filed in court, a bail hearing will be scheduled. During this hearing, the lawyer and prosecution will have the opportunity to inquire about the status of the ongoing case with the Police Enquiry officers. Subsequently, the court will determine whether to grant bail within approximately three days.

If bail is granted, the court will establish specific terms and conditions that the accused must adhere to. It is important to note that every 21 days, a Bail and Remand Court (BRC) session will take place, during which the accused can request a reduction in the bail amount.

 

Dismissing cases in Mauritius is rare, and a strikeout can only be requested under specific favorable circumstances.

Additionally, the completion and submission of the investigation report to the public prosecution are essential before considering such options. Until the handover is completed, the commissioner of police will ensure the proper follow-up of the case by the investigation officers.
